The text message you would receive will be: "TEXT BEFORE TOW: Your vehicle is parked in a manner creating a safety violation and will be towed at your expense. Please relocate your vehicle immediately to resolve the safety violation and avoid being towed. This is a courtesy message from the City of Miami Beach.”

Miami Beach Curb Notifications — SMS Terms of Use

These Terms of Use ("Terms") govern the text message (SMS) notification program (the "Program") operated by Automotus, Inc. ("Automotus," "we," "us") on behalf of the City of Miami Beach (the "City") in connection with [curbside loading, parking, and street activity] within the City. By opting in to the Program, you agree to these Terms and to the SMS Privacy Policy located at https://www.miamibeachfl.gov/policies-disclaimers/#sms-privacy (the "Privacy Policy"). If you do not agree, do not opt in.

1. Program description

The Program sends text messages to enrolled mobile numbers regarding towable parking violations. Messages are informational and are sent only to users who have provided express consent.

2. How to opt in

You may enroll by [entering your mobile number and checking the consent box at https://cmb.my.site.com/permit. By enrolling, you confirm that you are the authorized user of the mobile number provided, that you are at least 18 years of age, and that you consent to receive automated text messages from Automotus on behalf of the City at that number. Consent to receive text messages is not a condition of purchasing any goods or services or of receiving any City service.

3. Message frequency

Message frequency varies based on [curb activity in your selected area and your notification settings]. You may receive up to 100 messages per day.

4. Cost

Message and data rates may apply. Standard charges from your wireless carrier apply to every message sent or received under the Program. Automotus and the City do not charge for Program messages. Check with your carrier for details about your plan.

5. How to opt out

You may cancel at any time by replying STOP to any Program message. After you send STOP, you will receive one final confirmation message and no further Program messages will be sent to your number. If you wish to re-enroll, opt in again using the methods in Section 2.

7. Privacy and use of your mobile information

Your mobile phone number, opt-in information, and messaging consent data are used solely to operate the Program as described in the Privacy Policy. We do not share, sell, rent, or otherwise provide your mobile phone number, opt-in information, or messaging consent data to third parties or affiliates for marketing or promotional purposes. Mobile information will not be shared with any third parties for their own marketing purposes under any circumstances. Automotus may use technology service providers (for example, a messaging platform vendor) to transmit messages on our behalf; those providers may access your mobile number only as needed to deliver messages and may not use it for any other purpose.

Automotus operates the Program as a service provider to the City. Information provided to the City may be a public record under Florida law and subject to disclosure upon request, except as exempted by law. This does not permit use of your mobile information for marketing or promotional purposes.

8. Supported carriers

The Program is supported by major U.S. carriers, including AT&T, T-Mobile, Verizon, and others. Carriers are not liable for delayed or undelivered messages.

9. Changes to your mobile number

If you change or deactivate your mobile number, you are responsible for opting out of the Program before doing so. Automotus is not responsible for messages sent to a number that has been reassigned to another user.

10. Disclaimer

Program messages are provided for informational convenience only. Automotus and the City do not guarantee the timeliness, accuracy, or delivery of any message. Message delivery is subject to effective transmission by your wireless carrier and network availability. Program messages do not replace posted signage, City ordinances, or official notices, and you remain responsible for complying with all applicable parking and curb regulations regardless of whether you receive a message.

11. Limitation of liability

To the fullest extent permitted by law, Automotus and the City shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to the Program, including any delayed, misdirected, or undelivered messages or any charges imposed by your carrier.

12. Changes to these Terms

We may update these Terms from time to time. The current version will always be posted at https://www.automotus.ai/miami-beach-sms with its effective date. Continued participation in the Program after an update constitutes acceptance of the revised Terms.
